By way of present writ petition filed under Article 226/227 of the Constitution of India, petitioner has approached this Court inter alia for issuance of a writ in the nature of mandamus directing the respondents to allow the petitioner to deposit the stamp duty for issuance of conveyance deed as per the actual amount, deposited by him in accordance with regular letter of allotment dated 29.03.2023, for plot No.66, Industrial Estate, Panipat, instead of its tentative price of Rs.29,03,85,000/-.

Counsel for the petitioner submits that during the pendency of the instant petition, petitioner has deposited the requisite stamp duty, as demanded by the respondents. He, however, submits that the petitioner is entitled to refund of the excess amount deposited, as the petitioner is liable to deposit stamp duty at the discounted price of Rs.26,13,46,500/-, and not at the price as claimed by the respondents. He submits that during the pendency of the instant petition, conveyance deed has been executed. He seeks and is granted permission to withdraw the writ petition, with liberty to file a fresh one claiming refund of excess amount deposited by him, as well as to lay a challenge to circular dated 18.09.2023, Annexure R-1, which has been issued during the pendency of the instant petition.
