(ORAL) Mr. Akshay Bhan, learned Senior Counsel assisted by Mr. Alok Mittal, Advocate submits that despite two demarcation reports, the property measuring 4232 sq. yards is in illegal possession of the respondent but no action has been taken so far.

This Court confronted Mr. Bhan qua availing the remedy under the provisions of section 34 of the Specific Relief Act. At this state, Mr. Bhan submits that he will be satisfied in case the representation (Annexure P-8) submitted in this regard to the Deputy Commissioner, Gurgaon is decided within a stipulated time frame.

Accordingly, the writ petition is disposed of with direction to the Deputy Commissioner, Gurgaon to decide the representation submitted by the petitioner vide Annexure P-8 keeping in view the demarcation reports as expeditiously as possible and preferably within a period of three months from the date of receipt of copy of this order.
