1. The petitioners who are all members of the Bathinda Housing Complex Cooperative House Building Society Ltd. Bathinda, seek issuance of writ in the nature of certiorari for setting aside the impugned order dated 28.4.2023 (Annexure P-14) passed by respondent No.1, whereby a revision petition filed by the petitioners has been dismissed. The petitioners also assail order dated 16.6.2022 (Annexure P-13) passed by respondent No.2 as well as order dated 29.6.2015 (Annexure P-8) passed by respondent No.3.

2. The controversy in nutshell is that one Gurjit Singh (respondent No.6) was employed by the society in the year 2002 on daily wages @ Rs.70/- per day. The petitioners are mainly aggrieved by granting of a pay scale to respondent MOHAN SINGH 2023.08.31 19:59 I attest to the accuracy and authenticity of this order/judgment

CWP-19177-2023 (O&M) ( 2 ) 2023:PHHC:114165 No.5 who according to the petitioners is not even a regular employee and that there are no service rules in respect of the same.

Having heard the learned counsel for the petitioners and having perused the documents annexed with the petition, but without commenting anything as regards the merits of the assertions made in the petition, the instant petition is disposed off with a clarification that in case respondent No.6 Gurjit Singh is not a regular employee, the Managing Committee of Society, if deemed appropriate, may re-examine the matter regarding emoluments being paid to respondent No.6, being an ad-hoc employee, as stated by petitioner's counsel. However, in case any such exercise is to be conducted, a prior notice has to give to respondent No.6 and in case of any adverse decision, a reasoned order should be passed.
