Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.36 dated 13.08.2018 under Sections 379-B IPC, registered at Police Station Majitha Road, District Amritsar. Notice of motion.
Mr.Ramandeep Sandhu, Sr.DAG, Punjab, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the FIR in the present case has been registered on the basis of complaint of Dr.Neeraj Sharma, wherein, it is alleged that when she parked her Activa near Principal's office, two persons VINEET GULATI 2019.11.19 10:26 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-36006 of 2019 -2came and snatched her purse containing phone make Lenovo, `4000/- and other articles. One Amit Kumar, who had been arrested in case FIR No.67 dated 29.10.2018 under Section 379-B IPC made disclosure statement that he accompanied by the petitioner, had snatched the purse of the present complainant and her mobile phone has been given to the petitioner as part of his share. The petitioner was taken into custody and on his disclosure statement, mobile phone has been recovered.
The investigation in the case is complete. The petitioner has been in custody since 12.11.2018.
Without commenting anything on the merits of case, in my opinion, no useful purpose will be served by detaining the petitioner during trial. The petition, as such, is accepted. Petitioner Rakesh Kumar is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate, concerned.
