The present petition filed under Section 528 of BNSS, 2023 (corresponding Section 482 Cr.P.C.), seeking direction for registration of FIR against the other side, is not maintainable and is liable to be dismissed on the ground of maintainability as the petitioner has got efficacious alternative remedy, as provided in BNSS, 2023. 2.
The petitioner after failing to get his FIR registered, has an option to seek direction under Section 156(3) of Cr.P.C. (corresponding Section 175(3) of BNSS, 2023), by approaching the Court of Judicial Magistrate, First Class, under whose jurisdiction the occurrence has taken place.

Further, the present petitioner has also got efficacious remedy to file a criminal complaint.
