CORAM: HON'BLE MR. JUSTICE ARUN MONGA Present :

Mr. Dinesh Nagar, Advocae, for the petitioner.

Mr. Karan Kumar Jund, Central Government Counsel, for the respondent-UOI.

(Presence marked through video conference).

ARUN MONGA, J. (ORAL) Petitioner herein seeks issuance of a writ in the nature of mandamus directing the respondents to renew/extend his service tenure by allowing him to continue his job as Mess Cook at Vindhya Hostel, Punjab Engineering College at Chandigarh.

2.

Learned counsel contends that similarly situated other employees have been given the benefit of extension in their contractual services as borne out from Annexures P-6 and P-7 but the petitioner has been denied the same for extraneous reasons. He submits that the job requirement at Vindhya Hostel, Punjab Engineering College, Chandigarh for a mess cook still exists and the vacancy is also available yet the contract of the petitioner as a cook has not been extended. Even though he has been working as such since the month of April, 2013 and his services were renewed every six months from time to time as is borne out from Annexures P-2 and P-3 3.

Learned counsel further submits that petitioner submitted a representation dated 03.11.2020 (Annexure P-5). The same has not been adverted by the respondents till date. Hence, the instant petition. SONU 2020.12.22 15:53 I attest to the accuracy and integrity of this document

7.

Without commenting on the merits of the case, writ petition is disposed of with a direction to the competent authority to look into his representation dated 03.11.2020 (Annexure P-5) and also by keeping in view the contentions raised in the present petition by treating it as supplementary representation and decide the same by passing a speaking order, in accordance with law.
