Prayer in this writ petition filed by the petitioners under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to grant the proportionate increment to the petitioners on completion of more than six months service before retirement by granting the same and to fix the pension on the last pay drawn with all consequential retiral benefits including re-fixation of pension and other retiral benefits along with all arrears with interest @ 18% per annum.

Learned counsel for the petitioners, at the very outset, confines his prayer for deciding legal notice dated 15.05.2024 (Annexure P-9). He submits that at this stage, petitioners would be satisfied, if the said legal notice is decided by passing a speaking order within a time bound frame.

Mr. Saurabh Mohunta, DAG, Haryana, accepts notice on behalf of the respondents and has no objection to the innocuous prayer made by learned counsel for the petitioners.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.3 to decide legal notice dated 15.05.2024 (Annexure P-9), submitted by the petitioners expeditiously by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
