Counsel for respondent No.2 submits that present petition has been rendered infructuous on account of the fact that amount sought to be assessed, has already been assessed as Rs.1,32,01,389/- on 30.10.2019. 2.
Thereafter, in compliance to the direction passed by learned Tribunal, 40% of the assessed amount i.e. Rs.52,80,556/- has been deposited by the employer and the appeal is pending for adjudication. 3.
On account of the statement made by counsel for respondent No.2, counsel for the petitioner seeks withdrawal of the present writ petition, with liberty to file a fresh one, if necessity arises, after the decision of the Appellate Authority.

Thus, present writ petition stands dismissed as withdrawn, with the liberty as sought and recorded here above.
