AMOL RATTAN SINGH, J. (Oral) By this petition, filed under the provisions of Article 226 of the Constitution, the petitioner is seeking a direction to respondent nos.3 to 5 to protect her life and liberty at the hands of respondents no.6 and 7, who are allegedly preventing her to testify against them in a complaint case, bearing no.COMI-166 of 2015, titled as 'Preeti vs. Om Parkash and others', under Sections 376-D/323/324/328/34 of the IPC (as alleged). Other than the orders earlier recorded, on 9.11.2021 the following order had been passed by this court:- "Pursuant to the order dated 04.03.2021, an affidavit dated 18.03.2021 has been filed by the Commissioner of Police, Jalandhar, which had not been taken on record so far PRAVEEN KUMAR 2021.11.23 11:34 I attest to the accuracy and integrity of this document
CRWP no.10471 of 2020 as the turn of the case never came up for actual hearing after that date.
The affidavit is consequently ordered to be taken on record.
It being past 4:00 p.m. by the time that the case has been called out, possibly for that reason counsel for the petitioner is not present though Mr. N.S.Sodhi, Advocate, appears for respondents no.6 and 7 and wishes to address arguments, also stating that the petitioner is now in custody. Obviously, with counsel for the petitioner not being present today, no order on merits could be passed by this court in his absence. Adjourned to 22.11.2021.

Today, learned counsel appearing for the petitioner submits that the petitioner does not wish to pursue this petition. In view of the above, without making any comment on the actual merits of the case, the petition is ordered to be dismissed as withdrawn, with however the status report filed by the DCP, Investigation, Jalandhar, dated 26.2.2021, taken on record with no formal order in that regard having been earlier passed.
