This petition has been filed for issuance of a direction to release the legitimate refund of Rs.36,78,222.70/- along with interest to the petitioner-firm, which is lying pending from last around one year, the details of which are mentioned in chart dated 30.10.2021 (Annexure P-5) as the same has been illegally withhold without any reasons. 2.

The main grouse of the learned counsel for the petitioner is that despite several representations made by the petitioner-firm, the matter has not been finalized by the respondents.

Mr. Sourabh Goel, Advocate, appears and accepts notice on behalf of the respondents.

Learned counsel for the petitioner states that in this regard, the petitioner has already sent a representation dated 31.05.2021 (Annexure P-4) to the concerned Commissioner and that he would be satisfied at this stage if in the first instance a direction is issued to respondent No.2 to decide the VIRENDRA SINGH ADHIKARI 2021.11.03 17:39 I attest to the accuracy and integrity of this document

We find this to be a fair request. Resultantly, respondent No.2 is directed to decide the representation dated 31.05.2021 (Annexure P-4) of the petitioner by passing a speaking order within a period of one month from the date of receipt of the certified copy of this order. 7.

This petition stands disposed of in the above terms. 8.

Since the main case has been decided, the pending application, if any, also stands disposed of.
