(ORAL) The contention of the petitioner is that in the proceedings initiated under Section 65 of the Punjab Cooperative Societies Act, 1961, certain writ petitions are pending, however, during the pendency of the aforementioned writ petitions, a notice has been issued calling for objections for the purpose of holding election of the Managing committee and has restricted the consideration regarding the members upto 195, which is illegal and perverse. However, on 13.02.2013, a list of 439 members was published in which names of petitioners also found place. No doubt, the petitioners are entitled to file objections and in case, objections are filed the Administrator shall consider their grievance regarding enrollment as member, in essence, shall not confine only to 195 members.
The petitioners shall file objections within a period of 7 days from the date of receipt of certified copy of this order, giving all the details and orders regarding the enrollment of the members to be considered upto 13.02.2013 and the Administrator shall consider the same after giving opportunity of hearing to the petitioners and all other similarly situated persons who have not approached the respondents regarding preparation of PANKAJ KUMAR 2017.03.
CWP No.5361 of 2017 -2the list of members and pass a speaking order thereon within a period of 10 days thereafter.
The writ petition stands disposed of with the above observations.
