This is an application under Section 528 of BNSS, 2023 for revival of the main petition.

Learned counsel for the applicants-petitioners has submitted that certain averments have been made in the present application inadvertently. It is further submitted that actually the counsel could not appear on account of there being some technical issues at the end of counsel for the applicants-petitioners. It is submitted that liberty has been granted to the applicants-petitioners to revive the same in case they wish to pursue the case and since the applicants-petitioners wish to pursue the
-2case and even the cause survives, thus, the order dated 23.06.2026 be recalled and the case be restored to its original number. 3.
Keeping in view the above, the present application is allowed. The order dated 23.06.2026 is recalled and the main petition is restored to its original number.

The present Criminal Writ Petition has been filed under Article 226 of the Constitution of India for directing respondents no.2 and 3 to protect the life and liberty of the petitioners. 2.
It is the case of the petitioners that they both are major inasmuch as petitioner no.1 was born on 04.08.1994, as is apparent from her Aadhar Card (Annexure P-1), and petitioner No.2 was born on 16.10.2002, as is apparent from his Aadhar Card (Anneuxre P-2) and have married each other on 19.06.2026, with their free consent and without any pressure and that this is their first marriage. Reliance has been placed upon the photographs (Annexure P-3) and marriage certificate (Annexure P-4). It is also stated by the learned counsel for the petitioners that a detailed representation dated 19.06.2026 (Annexure P-5) has also been given to respondent No.2 by the petitioners for protection of their life and liberty as they have apprehension of danger to their life and liberty at the hands of private respondents. It is prayed that the petitioners would be satisfied in case respondent No.2 is directed to look into the said representation dated 19.06.2026 (Annexure P-5) in accordance with law.

Notice of motion to respondent nos.1 to 3 only. 4.
On advance notice, Ms. Gagandeep Kaur, DAG, Punjab, appears and accepts notice on behalf of respondent Nos.1 to 3 and on a specific query put by this Court, she has stated that she has no objection in case, respondent No.2, looks into the representation dated 19.06.2026 (Annexure P-5) and takes appropriate action in accordance with law. 5.
After considering the above said facts and without commenting upon the legality of the marriage and expressing any opinion on merits of the case, the present Criminal Writ Petition is disposed of with direction to respondent No.2, to look into the representation dated 19.06.2026 (Annexure P-5) and after considering the threat perception to the petitioners, respondent No.2 will take appropriate action in accordance with law.

It is, however, clarified that this order shall not debar the State from proceeding against the petitioners, if involved in any criminal case.
