**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present case, the petitioner has approached this court claiming the retiral benefits.

As per averments made in the petition, petitioner retired from service on 31.08.2018. After the retirement, the petitioner has only been paid `3,00,000/- and that too without giving any description as to under what head the said amount has been paid. Further, there is no impediment for the release of the pensionary benefits as no departmental inquiry or any other proceeding is pending against the petitioner, which would entitle the respondents to withhold the pensionary benefits. For the relief which has been sought in the present writ petition, the petitioner has made a representation dated 30.08.2018 (Annexure P-2), which is still pending consideration with the respondents and at this stage a time bound direction is given to the respondents to decide the said legal notice.

CWP-30759-2018 -2In view of the above, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the representation dated 30.08.2018 (Annexure P-2) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.

Present writ petition stands disposed of.
