CORAM: HON'BLE MR. JUSTICE RAVI SHANKER JHA, CHIEF JUSTICE HON'BLE MR. JUSTICE ARUN PALLI
Present:
Mr. R.K. Arora, Advocate, Mr. Jugam Arora, Advocate, for the petitioner.
Mr. Deepak Balyan, Additional Advocate General, Haryana. * * * * RAVI SHANKER JHA, C.J. (ORAL) This writ petition has been filed by the petitioner claiming benefit of the Post-Matric Scholarship Scheme of the Government of India alleging that though he has been allotted an MBBS seat in respondent No. 5 - Adesh Medical College and Hospital, Shahbad (M), Kurukshetra, he is not being given the benefit of the Government of India as well as the Government of Haryana's notifications giving time to deposit admission fee to Scheduled Caste and Scheduled Tribe candidates availing benefit under the said scheme.
As per clause (ix) and (x) of the notification dated 09.06.2023 issued by the Government of Haryana, the competent authority to take a decision in this regard is the Admission Committee and the appellate authority for taking up an appeal against the decision of the Admission Committee is the Director, Medical Education and Research, Haryana. As the petitioner has already approached the Admission Committee by filing a representation dated 06.08.2023 (Annexure P-16) and the same is pending before the said authority, learned counsel for the petitioner submits that the said authority may be directed to take a decision thereon expeditiously in accordance with law in view of the fact that the petitioner has already been allotted a seat and in case any adverse orders are passed he will lose his right to admission.
Mr. Deepak Balyan, learned Additional Advocate General, Haryana, submits that the petitioner's representation shall be considered and decided by the Admission Committee within a period of two days in accordance with law. In view of the aforesaid submission made by learned counsel for the petitioner as well as the statement of learned State counsel, the writ petition stands disposed of in terms thereof.
