CHANDIGARH CWP-20928-2022 (O&M) Date of Decision:14.09.2022 Sandeep .....Petitioner

Versus

State of Haryana and others

...Respondents

CORAM: HON'BLE MR. JUSTICE ARUN MONGA

Present:

Mr. Saurabh Dalal, Advocate for the petitioner.

Mr. Pankaj Middha, Addl.A.G., Haryana.

***** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of Certiorari for quashing office letter dated 17.05.2022 (Annexure P-6) issued by respondent No.4 whereby, the petitioner has been offered to join on the post of Data Entry Operator.

2.

Petitioner is aggrieved against the change of his designation to Data Entry Operator, as against his expectation of being appointed on the post of Junior Field Investigator on which he claims he had been serving for the past 9 years with unblemished record. 3.

On advance service, the learned State counsel appears and submits that merely because the petitioner was earlier engaged on the post of Junior Field Investigator does not amount to vesting of any right to claim appointment on the said post, particularly when the earlier contractual appointment was also as Data Entry Operator. 4.

Be that as it may, in matters of contract this Court would ordinarily refrain to interfere in extraordinary writ jurisdiction as the rights are confined within the four corners of terms and conditions of the ASHISH 2022.09.15 09:43

CWP-20928-2022 (O&M) -2contract. Petitioner has already been offered an appointment and it is for him to accept the same or not and to seek quashing of such an offer is not within the scope of this Court. However, as regards his right to be engaged on the post of Junior Field Investigator, it is for the respondents to decide, if they so wish, to allow him to continue to serve on the said post, despite his designation being Data Entry Operator, as was the case earlier, given his experience on the said post as has been pleaded herein. 5.

Dismissed.
