M/S Cititech Pvt.Ltd.And Another v. Permanent Lok Adalat And Others
IN THE HIGH COURT FOR THE STATES OF PUNJAB AND HARYANA AT CHANDIGARH.
CWP No. 5420 of 2017 Date of decision: 16.3.2017 M/S Cititech Pvt. Ltd and anr Petitioners vs.
/Permanent Lok Adalat and others Respondent
Present:
Mr. Rajiv Kataria, Advocate.
M.M.S.BEDI,J.
The petitioners were proceeded against ex-parte and the Permanent Lok Adalat, Public Utility Services, Karnal has passed an exparte Award, requiring the petitioners to return a sum of Rs. 15,34,720/- along with damages vide Annexure P-3 dated 29.2.2016. The petitioners seem to have not filed any application for setting aside the ex-parte order/ proceedings against them or the final Award dated 29.2.2016. The petition appears to be not maintainable and is disposed of by relegating the petitioners to an alternative remedy of approaching the Permanent Lok Adalat, Public Utility Services, Karnal seeking to set aside the ex-parte order. In case, any such application is filed within a period of 15 days, the same would be entertained and disposed of by giving a fair opportunity to the petitioners.
It will be appreciated in case the application is decided expeditiously, preferably within a period of six months. March 16 ,2016 ( M.M.S.BEDI ) TSM JUDGE Whether speaking/ reasoned Yes/ No Whether Reportable Yes/ No Tapinder Singh Mann 2017.03.
