This is a third petition that has been filed for grant of regular bail to the petitioner in case FIR No.217 dated 08.10.2017 registered under Sections 376, 120-B IPC and under Section 6 of POCSO Act, 2012 at Police Station Canal Colony, Bathinda.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is in custody since 05.10.2017. The investigation is complete and challan has already been presented, therefore, no useful purpose would be served in keeping the petitioner behind the bars. 3.

Learned counsel appearing on behalf of respondent-State on instructions from HC Resham Singh submits that petitioner does not deserve concession of bail keeping in view the gravity of offence committed by him, while further submitting that statement of prosecutrix is yet to be recorded.

Keeping in view the fact that prosecutrix was 13 years of age at PANKAJ KUMAR 2020.01.20 16:31 I attest to the accuracy and integrity of this document

CRM-M No.42766 of 2019 -2the time of commission of offence and statement of material witness i.e. the prosecutrix is yet to be recorded, this Court is not inclined to grant concession of regular bail to the petitioner at this stage. Consequently, the petition stands dismissed.
