AMIT RAWAL J. (Oral) Learned counsel for the petitioner seeks leave of the Court for withdrawal of the present writ petition with liberty to move an appropriate application before the Commissioner by which he withdrew the proceedings on the basis of compromise. The provisions of law are that where the proceedings had been withdrawn on the basis of the compromise, it is the same very Court which would have a jurisdiction for reviving of the application or revision in case of failure of compromise. In case, any such application is filed within a period of 15 days from today, the same shall be decided in accordance with law and there shall be no objection qua limitation and application for stay also.
With the aforementioned observations, the writ petition stands dismissed as withdrawn with the liberty as prayed for.
