Petitioner states that he was working as Staff Nurse (male) on contract basis in Guru Nanak Dev Hospital, Amritsar since the year 2012. Vide order dated 17.04.2018, his service was terminated from back date i.e. 13.12.2016 on the ground that he was continuously absent. Notice of motion. On the asking of court, Ms. Anu Chatrath, Addl. A.G. Punjab, who is present in court accepts notice. Limited question that arises for consideration of this court is whether the services could have terminated from the back date. In this regard, the order is cryptic and non-speaking. Learned State counsel at the outset submits that fresh order shall be passed by the authority as per law within one month from today.

In view of statement made by learned State counsel, no further direction is necessary. Petition is hereby disposed of. It is made clear that order dated 17.04.2018 (Annexure P-17) will not stand in the way of the authority to pass a fresh order.
