***** ARCHANA PURI, J. (Oral) Perusal of the paperbook reveals that on the last date of hearing, despite service, the respondent did not make appearance. Even today, he has not made appearance. As such, the respondent is proceeded against ex parte. The counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. HMA/211/2025 titled 'Tejinder Pal Singh v/s Smt. Simarjeet Sidhu', filed by the respondent-husband, pending in the Family Court, Sangrur and she seeks transfer of the same to the Court of competent jurisdiction at Barnala. At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 15.11.2009 and the son born from the wedlock, who is about 14 years old, is in the care and custody of the applicant. On account of the matrimonial dispute, the parties are residing separate. The applicant is doing teaching job at Village Jharon. Also, it is submitted that one complaint under Section 12 Sonu 2025.08.28 18:40 I agree to specified portions of this document P&HHC

TA-857-2025 of Protection of Women from Domestic Violence Act, as well as petition under Section 144 of Bharatiya Nagarik Suraksha Sanhita, which are pending in the courts at Barnala and the respondent is making appearance in both the said cases.

Considering the mitigating circumstances aforesaid, more particularly, when the applicant is taking care of the son born from the wedlock and the respondent having not come forward to resist the transfer application, the same is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/211/2025 titled 'Tejinder Pal Singh v/s Smt. Simarjeet Sidhu', filed by the respondent-husband, stands transferred from the Family Court, Sangrur to the Court of competent jurisdiction at Barnala. The requisite record of the aforesaid case be sent by the Family Court, Sangrur to the District and Sessions Judge, Barnala. Learned District and Sessions Judge, Barnala, shall assign the said petition to the Family Court, Barnala. Even, the parties are directed to appear before the Family Court, Barnala, within a period of one month from today onwards.
