This matter is being taken up for hearing through video conferencing due to the outbreak of pandemic, COVID-19. Petitioner seeks quashing of memo dated 29.04.2010 (Annexure P-4) vide which benefit of Assured Career Progression (ACP) Scheme as formulated vide Policy dated 03.11.2006 (Annexure P-3) has been declined to the category of Junior Engineers/Assistant Engineers in spite of the said claim being allowed by this Court.

It is submitted that case of petitioners is squarely covered by decision dated 20.05.2013 in CWP-16446-2010, titled 'Jaswinder Singh Bedi and others Vs. State of Punjab and others', which has been upheld by the Division Bench of this Court on 19.12.2014 in LPA-244-2014. CWP-21558-2020 Learned counsel for the petitioners submits that despite service of legal notice dated 19.10.2020 (Annexure P-8), the respondent-authorities are not taking any action on the petitioners' claim. At this stage, learned counsel for the petitioners restricts his prayer for a decision on the legal notice dated 19.10.2020 (Annexure P-8), in a time bound manner.

Notice of motion.

Mr. Abhay Pal Singh Gill, Asst. A.G., Punjab, accepts notice on behalf of all the respondents. Advance copy of the writ petition stands served. Learned counsel for the State does not raise any serious objection to the limited prayer addressed by the petitioners. Keeping in view the facts and circumstances of this case, but without any expression of opinion on the merits of the matter, this petition is disposed of with a direction to the competent authority to consider and decide legal notice dated 19.10.2020 (Annexure P-8), within a period of two months from receipt of certified copy of this order. In case, the petitioners are found entitled to any benefits, same be released within four weeks thereafter.

Petition is disposed of accordingly.
