Petitioner seeks quashing of order dated 31.01.2026 of learned Judge, Special Court, Ferozepur in case No.SC/223/2024 titled State Vs. Shubham and Others" vide which his bail and surety bonds were cancelled and forfeited to the State and non-bailable warrants were issued against him in FIR No.81 dated 02.06.2023 under Sections 399 and 402 IPC, Police Station Sadar Ferozepur, District Ferozepur. Section 25 of the Arms Act was added in the FIR during investigation.

Learned counsel for the petitioner submits that petitioner who was accused in above-mentioned FIR was allowed regular bail by learned Sessions Judge, Ferozepur vide order dated 21.05.2024 (Annexure P-2). He had been regularly appearing before learned Trial Court in the present case as well as in SC/12/2024 with the same title. Petitioner appeared in the other matter on 15.01.2026 which was adjourned to 08.04.2026. Petitioner with his limited education was of the impression that his presence was marked in both cases, due to which, on 31.01.2026, he failed to put in appearance in case No.SC/223/2024. CRM-M-34545-2026 (O&M) Ferozepur cancelled his bail order. Bail and surety bonds of the petitioner were also cancelled and he was summoned through non-bailable warrants of arrest for 24.03.2026. Learned counsel further submits that petitioner was ready to surrender in the Court but was fearful on account of non-bailable warrants of arrest and some protection may be granted. 3.

Notice of Motion.

Mr. Kunwarbir Singh, AAG Punjab accepts notice on behalf of respondent-State and opposes the prayer of the petitioner. 5.

Petitioner was released on regular bail in the aforementioned FIR vide order dated 21.05.2024. Perusal of impugned order reflects that bail of the petitioner and his bonds have been cancelled and forfeited to the State. Although, there is no apparent illegality in the impugned order, it appears to the Court that petitioner bonafidely intends to join the proceedings and face trial. He must be permitted to do so. Petitioner is accordingly directed to put in appearance before learned Judge, Special Court, Ferozepur within 10 days from today and move requisite application for bail, which shall be decided the same day. Till then, non-bailable warrants of arrest of the petitioner shall remain in abeyance. 6.

The petition stands disposed of, on the above terms. 7.
