(Oral) The petition has been filed, inter alia, seeking a writ of mandamus directing the respondents to consider the petitioner's candidature under Backward Class-A category for the post of TGT English (ROH) in response to advertisement 2/2023, dated 21.02.2023.

As per undisputed facts on record, the closing date for submission of application form was 15.03.2023, and the candidates were required to submit latest/fresh BC-A/BC-B category certificate for the year 2022-23 issued in terms of Government instructions dated 22.03.2022. The petitioner submitted application form for the post as a General category candidate, and appeared in the selection process on that basis. As per final result of selection dated 27.07.2024, she could not be selected.

It is contended that the petitioner was issued BC-A category certificate only on 20.07.2023, and she could not have applied as reserved category candidate on that basis. However, she submitted representation to the Commission, dated 11.08.2023, Annexure P-9, requesting that her candidature be considered under BC-A category. The same has been rejected vide impugned order dated 15.01.2024, on the ground that the petitioner applied for the post as a General category candidate, and as per her own submission she was not in possession of latest BC-A certificate on the cut-off date, 15.03.2023. Accordingly, her candidature cannot be considered under the category. 4.

It is apparent on record that the petitioner possesses a BC-A certificate dated 20.07.2023, whereas cut-off/closing date for submission of application form was 15.03.2023. She knowingly applied for the post as a General category candidate and faced the selection process as such. After remaining unsuccessful, she cannot be allowed to seek change of category and/or consideration under BC-A category.
