**** HARSIMRAN SINGH SETHI , J. (ORAL) Petitioner has filed this writ petition for the release of the pensionary benefits.

It has been averred in the writ petition that the petitioner retired in the year 2005, but all the pensionary benefits have not been released so far.

Counsel for the petitioner states that a legal notice was served upon the respondents on 18.09.2018 seeking pensionary benefits. The said legal notice has already been replied by the respondents, vide reply dated 19.11.2018 (Annexure P-6). In paragraph 3 of the reply, it has been mentioned that the arrears of pension, DCRG and other benefits have been released to the petitioner and the pension is being regularly paid to him as well.

CWP-30928-2018 -2Counsel for the petitioner states that even in the above-said reply, only the arrears of pension, DCRG has been mentioned whereas there is no word in respect of the release of the commutation of pension, leave encashment, GPF and GIS.

Counsel for the petitioner states that the petitioner be given a liberty to file a detailed representation to the respondents claiming the above-said benefits, which according to the petitioner have not been released so far.

In view of the above, the present writ petition is disposed of with a liberty to the petitioner to file representation within a period of six weeks claiming the pensionary benefits, which according to him, have not been released so far. In case, any such representation is filed by the petitioner, the respondents are directed to decide the same within a period of three months from the date of receipt of a certified copy of this order. In case after passing of the order, it is found that the petitioner is entitled for any monetary benefits, the same should also be released to him within a period of four months from the date of receipt of certified copy of this order.

However, it is made clear that this Court does not express any opinion on the merits of the case and the claim being made in the present writ petition or the representation to be filed by the petitioner before the respondents.
