 Present petition has been filed under Section 438 Cr.P.C. seeking pre arrest bail in case FIR No.130 dated 18.08.2018, under Section 22 of the NDPS Act, registered at Police Station, Bhogpur, Jalandhar.

On 30.08.2019 while issuing notice of motion the following order was passed by this Court:

Contends that on account of the communication gap with his counsel, wrong date was noted and thus, the petitioner could not appear on 08.07.2019, which led to the cancellation of the bail bonds and forfeiture of surety amount.

It is contended by learned counsel for the petitioner that in terms of the above order, petitioner has already joined the proceedings.

Learned State counsel on instructions from SI Balwinder has acknowledged the above factual position.

In view of the above, order dated 30.08.2019 is made absolute.

Petition stands disposed off.

However, it is made clear that above observations may not be construed as an expression of opinion on the merit of the case pending before learned trial Court.
