Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner, namely Maninderpal Singh in case FIR No. 42 dated 17.06.2019, registered under Section(s) 323, 324, 341, 148, 149 & 506 IPC (Section 326 IPC was added lateron) at Police Station Begowal, District Kapurthala.

Learned counsel for the petitioner contended that petitioner has been falsely implicated in the case because of previous inimical relations and present FIR being a counter-blast.

Having heard the submissions made by learned counsel for the petitioner and perused the record, this Court is of the considered view that as per record, incised wound attracting the provisions of Section 326 IPC is attributed to the petitioner only and recovery of weapon of offence i.e. sickle is yet to be effected. As such, no case is made out to grant the concession of pre-arrest bail to the petitioner and present petition stands dismissed. (Shekher Dhawan) Judge September 09, 2019 "DK"
