JASGURPREET SINGH PURI , J. (ORAL ) The present petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail in FIR No.248 dated 26.9.2019, under Sections 379-B, 411 and 201 IPC, registered at Police Station City Faridkot, District Faridkot. Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case as he was not named in the FIR.

CRM-M-42310-2020 (O&M) Singh, has brought to the notice of this Court that earlier also the petitioner had filed petition for the grant of regular bail bearing number CRM-M4373-2020, which was dismissed on merits on 5.2.2020. He has further submitted that there is no change of circumstances in the present case so as to entitle the petitioner to file successive bail petition. He has further submitted that the complainant has been examined during trial and the petitioner has been identified by the complainant and therefore, no case for the grant of bail on merits is also made out. I have heard the learned counsel for the parties. It is a successive bail petition. Earlier petition for regular bail bearing number CRM-M-4373-2020, was also filed by the petitioner which was dismissed on merits on 5.2.2020.

The contentions of the learned counsel for the petitioner were considered. The petitioner has not been able to show any change of circumstance or any other justifiable reason as to why successive bail petition should be entertained. In view of above, the present petition is dismissed. December 22, 2020.
