The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered against him vide FIR No. 365, dated 28.7.2019, Police Station HTM, District Hisar, under Section 174-A IPC.

At the time of issuance of interim directions on 30.8.2019 the following order was passed:

"Contends that entire cheque amount has already been refunded by the petitioner and a reference in this regard is made to Annexure P-2. Thus, the pendency of the criminal proceedings arisen out of FIR under MOHAN SINGH 2021.08.31 18:36 I attest to the accuracy and integrity of this document

Notice of motion for 22.10.2019.

In the meanwhile, further proceedings on the basis of FIR No.365 dated 28.07.2019 under Sections 174-A IPC, Police Station HTM, District Hisar, shall remain stayed, till next date of hearing."

Learned State counsel has informed that in the instant case the proceedings have been stayed by co-ordinate Bench of this Court. 4.

Since the matter seems to have been compromised as the entire amount has been paid and while bearing in mind the nature of offence, custodial interrogation of the petitioner is not warranted. The petition, as such, is accepted and the interim directions issued by this Court vide order dated 30.8.2019 are hereby made absolute subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
