The Special Family Pension has been awarded by the Armed Forces Tribunal which is challenged by the Union of India before us. 2.

It is the admitted positions that the Ex Sepoy Major Singh was in service when he died in Army Hospital due to Sub Acute Hepatic Failure. It would, therefore, be deemed to be attributable to an aggravated by Military Service as held in the judgment passed by the Hon'ble Apex Court in the case of 'Bijender Singh v. Union of India and others, 2025 SCC OnLine SC 895 .

In view thereof, granting of Special Pension to the widow cannot be said in any manner to be unjustified or illegal. 4.
