*** HARSIMRAN SINGH SETHI, J. (ORAL) In the present petition, prayer of the petitioners is that they are continuously working on contract basis with unblemished record and the respondents intend to replace them with the similar set of contractual employees, keeping in view the Advertisement issued by the respondent-Department, which is contrary to the settled principle of law.

Considering the fact that the petitioners are continuously working with the respondents with unblemished record, present petition is disposed of with a direction to the respondents that the petitioners will be allowed to continue, if the work of the post on which the petitioners are discharging their official duty, still exists. If the work of the post on which the petitioners are working, no longer exists, appropriate speaking order will be passed in the light of the instructions issued by the Government in that regard, with detailed reasons and a copy of the same will be furnished to the petitioners and the respondents will be at liberty to take appropriate action in terms of the speaking order. In case, the petitioners are still aggrieved against the action of the respondents, they are at liberty to avail alternative remedy, as per law.
