Criminal Complaint No. 3535/17, under Section 138 of the Negotiable Instruments Act, District Faridabad, 1.

Challenging the order issuing proclamation, the petitioner had come up before this court.

Vide order dated 3-2-2020, a co-ordinate bench of this court had directed the petitioner to appear before the trial court within two weeks i.e. before Covid-19 lockdown.

The petitioner did not file any application seeking extension of time, as such this court shall presume that such directions were complied with. 4.

Regarding quashing of proclamation, a reference to the petitioner does not find the order dated 10.09.2018, which was fixed for effecting proclamation. The petitioner has challenged the previous order dated 10-09-2018, vide which the JMIC had directed the issuance of proclamation and date was fixed for 13-11-2018. Thus, there is nothing on record to know what order the court had passed on 13-11-2018. Resultantly, there is nothing to adjudicate further.
