ASHOK KUMAR VERMA, J. (ORAL) Through this petition under Section 482 Cr.P.C. prayer has been made for quashing of order dated 15.07.2022 (Annexure P-4) passed by the Judge, Special Court, Amritsar, vide which bail bonds and surety bonds of the petitioner were cancelled and forfeited to the State and nonbailable warrants of arrest of the petitioner have been issued due to his non-appearance in case No.NDPS/131/2022 dated 29.03.2022 titled "State of Punjab v. Avtar Singh @ Juggnu etc." arising out of FIR No.0069 dated 24.06.2021 registered under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (offence under Section 29 NDPS Act added later on) at Police Station Mohkampura, District Police Commissionerate Amritsar.

Brief facts of the case are that on 24.06.2022 one Karan @ Topi son of Sarabjit Singh regident of Village Vingi, Tehsil Khadur Sahib, District Tarn Taran, was apprehended with 17 grams of heroin. RAVINDER SINGH 2022.09.18 08:50 I attest to the accuracy and authenticity of this order/judgment

-2CRM-M-42780 of 2022 Subsequently, petitioner was nominated as accused in the aforesaid FIR under the provisions of Section 29 of the NDPS Act. Petitioner was granted concession of anticipatory bail by the trial Court on 25.01.2022. However, petitioner remained absent on 15.07.2022 without intimation to the Court, which resulted into cancellation of his bail and forfeiture of bail/surety bonds to the State. No cogent reason has been given by the petitioner for his absence.

In view of the above, this petition is dismissed. However, if the petitioner surrenders before the trial Court within ten days from today and files an application for regular bail, the trial Court will decide the same expeditiously in accordance with law.
