The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered against him vide FIR No.340 dated 23.06.2021 at Police Station City Kaithal, District Kaithal, under Sections 148/149/307/323 IPC and Sections 25/27 Arms Act. 2.

At the time of issuance of notice of motion dated 02.11.2021, the following order was passed:

"Learned counsel for the petitioner contends that even if the allegations as levelled in the FIR are taken to be correct, it is quite evident that there is infact enmity between the family of the complainant and the accused Satish and Sunil and on account of which the said accused accompanied by co-accused Pawan, Ruldu and Ram Chander (petitioner) are alleged to have inflicted injuries on the complainant and others. While Satish and Sunil are alleged to be armed with pistol and double barrel gun, the remaining coaccused including the petitioner are stated to be armed with 'sticks'. CRM-M-46276-2021 (O&M) Learned counsel submits that in the instant case 4 persons have been injured i.e. Ishan, Rajesh, Nafe and Raghbir and that it is only Raghbir who has sustained injuries which could be said to have been inflicted with 'sticks' and that all the said injuries are simple in nature.

Learned counsel has further submitted that in fact the petitioner has been falsely implicated being father of Sunil and Satish so as to pressurize the entire family of the said accused. It has also been submitted that several of the co-accused have already been granted anticipatory bail including Raju and Ruldu.

Learned State counsel upon instructions has informed that pursuant to interim directions issued by this Court, the petitioner has since joined investigation and is not required for any custodial interrogation and is not wanted in any other case.

In view of the aforestated position, the petition is accepted and the interim directions issued by this Court vide order dated 02.11.2021 are hereby made absolute subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
