Mr. Mohit Kapoor, Additional Advocate General, Punjab. MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking the concession of anticipatory bail in FIR No.104 dated 21.05.2023 under Section 25 of the Arms Act, 1959 registered at Police Station Mahilpur.

Learned State counsel has submitted that the petitioner has not approached this Court with clean hands as he has failed to make a mention of the various criminal cases, which are pending against him. It has been submitted that the petitioner has only made mention of one case registered under Section 306 of the IPC, however, the following cases also stand registered against him:- 1.

FIR No.159 dated 04.08.2018 under Sections 379, 411, 394 IPC, P.S. Garhshankar.

2.

FIR No.23 dated 24.02.2017 under Sections 363, 366-A, 376 IPC, P.S. Garhshankar.

3.

FIR No.132 dated 09.11.2018 under Sections 307, 353, 186 and Section 25 of the Arms Act, P.S. Mahilpur.

4.

FIR No.54 dated 29.06.2018 under Sections 397, 341 IPC and Section 25 of the Arms Act, P.S. City Banga.

It has still further been submitted that the petitioner has not cooperated with the investigating agency and hence, his custodial interrogation is required.

I have heard learned counsel for the petitioner and perused the relevant material on record.

In the wake of the submissions made by the learned State counsel, the petitioner does not deserve the extraordinary concession of bail.

The instant petition, therefore, stands dismissed. 7.

However, it is made clear that anything observed hereinabove shall not be construed to be an expression of opinion on the merits of the case.
