(ORAL) Through this petition under Section 482 Cr.P.C. prayer has been made for quashing of order dated 06.05.2022 passed by Additional Sessions Judge, Ludhiana, vide which petitioner has been summoned through non-bailable warrants of arrest due to his non-appearance in case arising out of FIR No.178 dated 01.07.2018 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Division No.6, Ludhiana.
Brief facts of the case are that on 01.07.2017 petitioner and his co-accused Sunil Kumar were found in possession of 6 grams of heroin, one small electronic scale, one plastic box, 10 small plastic pouches and one small spoon. Both were arrested at the spot and were granted regular bail by the Judge, Special Court, Ludhiana, vide order dated 26.07.2018. However, petitioner remained absent on 06.05.2022 without intimation to the Court, which resulted into cancellation of his RAVINDER SINGH 2022.09.19 17:33 I attest to the accuracy and authenticity of this order/judgment
-2CRM-M-43114 of 2022 bail and forfeiture of bail/surety bonds to the State. No cogent reason has been given by the petitioner for his absence. In view of the above, this petition is dismissed. However, if the petitioner surrenders before the trial Court within ten days from today and files an application for regular bail, the trial Court will decide the same expeditiously in accordance with law.
