**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present case, the petitioner has approached this Court for a direction to the respondents to finalize the inquiry proceedings, which were initiated by the respondents immediately before his superannuation.
Counsel for the petitioner states that the inquiry officer has already been given the report to the punishing authority where the same is pending for the last more than two years, but no action has been taken by the respondents. On account of non-action, the petitioner submitted that his pensionary benefits are being withheld and therefore, he has approached this Court seeking a direction that the disciplinary proceedings should be taken to the logical end at the earliest. CWP-31044-2018 -2which has been claimed in the present petition, the petitioner has served respondents with a legal notice on 24.09.2018 (Annexure P-10) and thereafter, a reminder has also been given on 12.11.2018 (Annexure P-11), but no decision has been taken till date and the petitioner will be satisfied, at this stage, in case a time bound direction is given to the respondents to decide the said legal notice.
In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 24.09.2018 (Annexure P-10) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.
Present writ petition stands disposed of.
