(Presence marked through Video Conference) ARUN MONGA, J. (ORAL) Petitioners herein, inter alia, seek issuance of an appropriate writ refraining the respondent authorities to not bring the post of Canal Guard in Group `C' service instead of Group `D'. 2.

Learned counsel for the petitioners submits that qua their aforesaid grievance, petitioners submitted a representation dated 18.03.2019 (Annexure P-7) and Justice Demand Notice dated 25.09.2021 (Annexure P-8) to respondent No.1 regarding up-gradation to the post of Canal Guard Group-D to Group-C in the Irrigation and W.R. Department but to no avail. Hence, the instant petition.

Learned State counsel, on advance service, joins proceedings and states that competent authority shall take appropriate decision on the pending representation dated 18.03.2019 (Annexure P-7) and Justice Demand Notice dated 25.09.2021 (Annexure P-8). 4.

At this stage, learned counsel for the petitioners also agrees that let a final decision be taken, either way, by the competent authority on the VANDANA 2021.11.09 14:48 I attest to the accuracy and integrity of this document

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the competent authority to look into the grievance of the petitioner as per representation dated 18.03.2019 (Annexure P-7) and Justice Demand Notice dated 25.09.2021 (Annexure P-8) and also by keeping in view the contention raised in the present petition by treating the same as supplementary representation and take a decision, in accordance with law.

Let the needful be done within a period of 04 months from today. If a favourable order is passed, benefit thereof be accorded within two months days thereafter.
