NIDHI GUPTA , J. (ORAL) Prayer in the instant petition filed under Section 528 of the Bhartiya Nagarik Suraksha Sanhita is for direction to the respondents to submit a status/action taken in case bearing FIR No. 0058 (Annexure P1) dated 29.03.2024 registered under Sections 354(D), 376(2)(N), 376 (D), 506 IPC at Police Station Bass, Tehsil Hansi, District Hisar. Learned counsel for the petitioner inter alia submits that there were 3 accused in the present case, two of whom are the cousin brothers of the petitioner and the other is a friend of cousin brothers. It is submitted that as there was some dispute regarding the disability certificate of the petitioner, the petitioner was forced to undergo physical relationship with all the 3 accused.

It is further submitted that for this reason, the petitioner was constrained to take divorce from her previous husband on 04.06.2020. However, the petitioner again solemnized marriage on 24.06.2021 but the accused are still harassing and blackmailing her. It is accordingly prayed that the investigation of DIVYANSHI 2024.08.

CRM-M-38834-2024 - 2this case be transferred from Police Station Bass, Tehsil Hansi, District Hisar to some other place.

Learned counsel for the State, on instructions from Lady ASI Geeta Rani, submits that the present petition has been rendered infructuous as the further investigation of the above-said FIR has been transferred from Police Station Bass to Police Station Women, Hansi vide order dated 07.08.2024 passed by Superintendent of Police, Hansi. Learned counsel for the State further submits that vide order dated 17.07.2024 passed by learned Judicial Magistrate 1st Class, Hansi, Investigating Officer has been directed to get conducted the polygraph test of the accused persons from FSL, Madhuban. A copy of the said orders are handed over in the Court, which are taken on record. Learned counsel for the petitioner submits that in view of the submissions made by learned counsel for the State, the present petition may be disposed of.
