***** RAJAN GUPTA , J. (Oral) Petitioner has prayed for a writ in the nature of mandamus to direct the respondents to reduce the amount of contract to a reasonable amount as his business has suffered due to introduction of "Service Centres".
At the outset, learned State counsel submits that present petition is not maintainable. Petitioner was successful in the open auction. He was required to deposit Rs.10,60,000/- in lieu of that. Petitioner merely wants to wriggle out the conditions of the auction.
This court finds substance in the plea of the State. However, learned State counsel submits that in view of the fact that petitioner may have deposited Rs.2 lacs in view of order dated March 20, 2017, his case shall be examined and a speaking order shall be passed. In view of statement made by learned State counsel, present petition is hereby disposed of.
