Aggrieved by the order dated 06.06.2024 passed by the Additional Sessions Judge, Palwal, petitioner has come up before this Court by filing the present petition. 2.

Perusal of the file shows that petitioner was acquitted by the trial Court, however the complainant filed an appeal before the Sessions Court which overturned the judgment convicting the petitioner. Aggrieved by the conviction, instead of filing an appeal against conviction, petitioner has come up before this Court by filing the present Criminal Revision Petition. Once there is specific statutory remedy it should be exercised and not a random remedy.

Given above, the present petition is not maintainable and the same is disposed of with liberty to the petitioner to file an appeal against conviction under Section 419 BNSS. It is clarified that time for which the present petition was pending, shall not be counted for the purpose of limitation. Pending applications, if any, stand disposed of.
