Prayer made in the present petition is for directing the respondents to release the pension/pensionary benefits of the petitioner. 2.

Learned counsel submits that the petitioner had retired as Deputy Director on 31.10.2022 and in the disciplinary proceedings initiated against him on 28.11.2019, he came to be exonerated on 01.11.2022, as per the averments made in para 5 of the petition and enquiry report appended as Annexure P-2. Regarding the claim raised in the present petition, a legal notice dated 12.12.2024, Annexure P-7, has been served upon respondent No.2, which has yet not evoked any response. She, on instructions, prays that a direction may be given to respondent No.2 to decide the same in a time bound manner, to which learned State counsel has no objection. 3.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondent No.2 to decide the legal notice dated 12.12.2024, Annexure P-7, within a period of 4 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon.
