AMIT RAWAL J. (Oral) The petitioner is seeking removal of the private respondent from the post of Director by invoking the writ of quo-warranto on the basis of criminal discharge and as per the provisions of Rule 8 of Punjab Civil Services (Punishment and Appeals) Rules, a person cannot be appointed or extension can be granted, in case, of issuance of charge sheet and imposition of penalty.
Mr. B.D.Sharma, Advocate has apprised this Court to the query raised on the last date of hearing, qua aforementioned observation that cancellation report has not been accepted and criminal revision in this regard is pending.
The factum of cancellation report is not the one as referred to in the writ petition, thus, the extension would have no connection.
