(Oral) Petitioner-Virender Kumar, aged 41 years, has filed this petition under Section 483 of BNSS 2023 (Section 439 of Cr.P.C) for grant of interim regular bail to the petitioner for a period of four weeks in case FIR No.123 dated 12.07.2024 under Sections 20, 29 of NDPS Act and 318(4), 347(1) and 317(2) of BNS Act (Corresponding Sections 420, 483, 411 of IPC) registered at Police Station Sadar Bahadurgarh, District Jhajjar. 2.
In response to the order dated 25.06.2026, learned State counsel submits that in fact on 13.06.2026 when the petitioner was taken for admission in the hospital for conducting surgery on 15.06.2026, concerned doctor informed that he won't be available as he has to go on leave, therefore, a fresh date for admission was given for 04.07.2026 and date for conducting surgery is now fixed as 06.07.2026.

On hearing the petitioner's counsel as well as learned State counsel and also going through the order dated 25.06.2026, with the JITENDER 2026.07.02 18:10 I attest to the accuracy of this document
CRM-M-34700-2026 explanation today given by learned State counsel, this Court is of the view that the nature of ailment/problem suffered by the petitioner would require some time for taking good diet and few days for taking rest also. Once it is admitted position that petitioner is suffering with the piles problem, requiring immediate surgery, let same be got treated by the petitioner himself as he has opted by filing the present petition.

Accordingly, the present petition for grant of interim bail is allowed and petitioner is ordered to be released on interim bail for a period of one month, subject to his furnishing bail/ surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/Duty Magistrate concerned. Petitioner shall surrender back to the jail on 04.08.2026 at 5:00 PM.

The observation made here-in-above shall not be construed as an expression of opinion on the facts of the case and the Trial Court is expected to decide the case on the basis of complete evidence available on record. 6.
It is further made clear that if, in future, petitioner is directly found indulged in similar kind of activities, this order shall be deemed to be cancelled.

Petition stands disposed of accordingly. However, only to get acquainted whether petitioner has surrendered back to the jail or not, let the petition be listed on 07.08.2026.
Pending application(s), if any, also stand disposed of accordingly.
