JUSTICE AMIT RAWAL -.- AMIT RAWAL J.(ORAL) The petitioner has the efficacious remedy to challenge the impugned order dated 24.10.2016 (Annexure P-10) by filing civil suit in order to prove the alleged misappropriation by the private respondent i.e. the Sarpanch, whose tenure as Sarpanch was w.e.f. 2008 to 2013. This Court in its inherent jurisdiction cannot decide the disputed question of fact. Reference has also been made to the report of the Deputy Commissioner but the order under challenge is passed by the Director, Rural Development and Panchayat. All these facts can only be proved by leading direct and cogent evidence.
