(ORAL) Learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to the petitioner to resort to the remedy of filing an appeal against the order dated 26.09.2012 (Annexure P-2) whereby major penalty of compulsory retirement had been imposed upon the petitioner, although learned counsel for the respondents points out that the remedy of filing the appeal against the afore-said order has also become time barred.

However, in view of the above-mentioned prayer of learned counsel for the petitioner, the present petition is hereby dismissed as having been withdrawn, with the liberty to the petitioner to avail the above-said remedy of filing the appeal, if otherwise permissible under the relevant law and prescribed rules.
