  Present petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to give one opportunity to the petitioners to change department/ post keeping in view their merit in the selection list of waiting candidates as has been given to other selected candidates in the main merit list in terms of Government instructions dated 24.06.2019 (P43).

At the outset, instead of pressing the petition on merits, learned counsel for the petitioners submits that he would be satisfied in case representation dated 12.11.2020 (P414) is decided by the competent authority, expeditiously.

      Mr. Kiran Pal Singh, AAG, Haryana, accepts notice on behalf of the respondents and he is not averse for the innocuous prayer made by the petitioners.

As per the provisions of Section 3 of The Haryana Group D Employees (Recruitment and Conditions of Service) Act, 2018, appointment to all Group D posts are to be made by Head of Departments/ Head of Office, but the circular dated 24.06.2019 regarding one time relaxation has been issued by the office of Chief Secretary, Haryana. Therefore, in view of the agreed stand taken by both sides; without going into the merits of the case, this Court deems it appropriate to dispose off the present petition with a direction to respondent No.14 Chief Secretary to Government of Haryana, to consider and decide representation dated 12.11.2020, by passing speaking order in accordance with law, within a period of 3 weeks' from today.

Ordered accordingly.
