Learned counsel for the petitioner submits that the petitioner was innocent and had been falsely implicated on account of an earlier dispute between the complainant and co-accused Suresh alias Sunny. Two co-accused namely Vinay @ Kullan who was armed with ice pick and Manoj had since been allowed regular bail by learned Additional Sessions Judge, Faridabad and petitioner, who was in custody for the last 3 months, too was entitled to the concession on the ground of parity. 4.

Learned State counsel has filed custody certificate and has opposed the prayer for regular bail arguing that petitioner was attributed lathi blows and his identity was clearly disclosed from the CCTV footage collected by the police. Learned counsel further submits that challan stood presented in the Court. Petitioner, who was in custody in three other cases did not deserve the concession of bail.

Petitioner is not named in the first information report. As per FIR, the assailants were in muffled faces. He has been attributed simple injuries with lathi and is in custody for the last more than 3 months. Investigation of the case is complete. Case is at initial stage. CCTV footage allegedly showing involvement of petitioner would require proof at the time of trial which is likely to take long to conclude. Offences alleged to have been committed by the petitioner are all triable by Court of Magistrate. Petitioner who is in custody w.e.f. 08.03.2026 deserves the concession of bail on the ground of parity. Mere pendency of three other cases would alone not be sufficient to refuse the concession of bail. The petition is accordingly allowed. Petitioner is ordered to be released on regular bail

CRM-M-34602 of 2026(O&M) -3subject to his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate.

All the pending miscellaneous applications, if any, stand disposed of.
