(ORAL) ase heard via Vide this petition, the petitioner seeks the concession of 'regular bail' under the provisions of Section 439 of the Cr.P.C., upon FIR no.333, dated 24.09.2019, having been registered at Police Station Sector-39, Chandigarh, alleging therein the commission of an offence punishable under Section 22 of the NDPS Act, 1985.
Pursuant to the last order passed on 22.12.2021, the learned Addl. P.P., U.T. Chandigarh, submits on instructions, that out of 14 prosecution witnesses 8 have been given up, and with 4 of the remaining 6 prosecution witnesses already having been examined and one having been partly examined, DINESH 2022.03.14 19:02 I attest to the accuracy and integrity of this document
CRM-M-42727 of 2020 -2and with the next date of hearing before the trial court being 31.03.2022. In the aforesaid circumstances, I would see no ground to entertain this petition any further, which is consequently dismissed, but with the trial court directed to ensure that the trial is now concluded at the earliest and with the SSP, Chandigarh, to continue to ensure that the witnesses as still remained to be examined, continue to appear before the trial court as and when summoned. The interim order passed in favour of the petitioner is hereby vacated. He will surrender before the trial court/jail authorities within one week from today.
If there is still a delay in concluding the trial, the petitioner would be at liberty to file a similar petition, which would be considered wholly on its own merits.
