HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.183 dated 18.11.2020 under Sections 326,323,324,34 IPC registered at P.S Sadar Gurdaspur, District Gurdaspur.

FIR was lodged on the statement of Surinder Singh, who alleged that on 12.11.2020 at about 8.30 am, he was going to his house from the house of Hardeep Singh. When he was coming from his house, in the street near to his house, Kamaljit Kaur, who was armed with danda inflicted two danda blows on the head and right shoulder of the complainant whereas her son (petitioner) armed with datar caused datar blow on right leg of the complainant. On alarm being raised, accused fled away. Learned counsel for the petitioner contends that there is unexplained delay in registration of the FIR and that the injuries are found to have been caused on the non-vital part of body of the complainant. The petitioner is in custody since 27.11.2020.

Opposing the petition, the learned State counsel has submitted that investigation is complete and challan has been presented on 21.12.2020. Charges have also been framed.

CRM-M-42721 of 2020 #2# Without commenting anything on the merits of the case and also bearing in mind the custody period and is not wanted in any other case, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Jashanpreet Singh is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
