(ORAL) In the present writ petition, the grievance which is being raised by the petitioner is that he is entitled for the leave encashment and the claim is against the private aided school i.e. Jain Senior Secondary School (Girls) (Permanent Recognized), Rai Market, Ambala Cantt.- respondent No.3.
Counsel for the respondents-State states that the State of Haryana has issued notification/letter dated 14.08.2018, by which the claim of the petitioner for the grant of leave encashment has already been accepted at par with their counterparts working in the Government Colleges. According to the said letter, the leave encashment benefit is to be given in terms of the calculation of the earned leave w.e.f. 09.04.1987 NARESH KUMAR 2019.04.02 09:37 I attest to the accuracy and integrity of this document Chandigarh

Further, as per the said letter, the amount to be paid as leave encashment shall be paid in share i.e. 95% by the State Government and 5% by the Colleges. Counsel for the respondents-State states that in view of the said notification, the present writ petition has been rendered infructuous. Counsel for the petitioner states that though the instructions/letter has been issued on 14.08.2018, but no benefit has been given to the petitioner so far.
Counsel for the respondents-State states that case of the petitioner will be considered in view of the letter dated 14.08.2018 issued by the respondents and an appropriate order will be passed in this regard within a period of two months from the date of receipt of certified copy of this order.
Keeping in view the statement given on behalf of the respondents-State, recorded above, counsel for the petitioner states that no further orders are required to be passed in the present writ petition and the same be disposed of as not pressed.
